You must be at least 17 years old to use FitJourney. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Description of Service

FitJourney is a fitness and weight loss tracking application that provides:

• A structured 600-day weight loss program
• AI-powered health coaching and recommendations
• Meal logging with photo analysis capabilities
• Exercise and workout tracking
• Apple Watch companion app for workout tracking
• Fasting timer and tracker
• Progress visualization and analytics

3. User Responsibilities

By using the App, you agree to:

• Provide accurate and truthful information about yourself
• Use the App only for lawful, personal, non-commercial purposes
• Not misuse, abuse, or attempt to exploit the App or its features
• Take responsibility for your own health decisions
• Consult healthcare professionals before making significant health changes
• Not rely solely on the App for medical or health decisions

4. AI Features and Limitations

The App uses artificial intelligence for various features including:

• Meal photo analysis for calorie and nutritional estimation
• Personalized meal plan suggestions
• Workout recommendations
• Motivational coaching

Important: AI-generated content is provided for informational purposes only. Calorie and nutritional estimates from photo analysis are approximations and may not be 100% accurate. Do not rely on AI recommendations as medical advice.

5. Premium Features and Purchases

FitJourney offers a Premium upgrade ($4.99 USD one-time purchase) that removes advertisements from the App. By making a purchase:

• You agree to pay the listed price at the time of purchase
• Payments are processed through Apple App Store or Google Play Store
• Purchases are non-refundable except as required by applicable law
• Premium status is tied to your App Store/Play Store account

To request a refund, please contact Apple or Google directly through their respective app stores.

6. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Zithera Technology Pty Ltd and are protected by Australian and international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App's content for commercial purposes

7. User Content

You retain ownership of any content you create or upload to the App (such as meal photos, notes, and logs). By using the App, you grant us a limited license to process this content solely for the purpose of providing App functionality (such as AI meal analysis).

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• Results from using the App will be accurate or reliable
• Any weight loss or health improvements will occur

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZITHERA TECHNOLOGY PTY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Personal injury or health issues
• Any damages arising from your use or inability to use the App
• Any damages arising from reliance on AI-generated content

11. Indemnification

You agree to indemnify and hold harmless Zithera Technology Pty Ltd from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us. You may stop using the App at any time by uninstalling it from your device.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the new Terms within the App. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
