Agreement to Terms

These Terms of Service ("Terms") govern your use of the Learndarin mobile application ("App") operated by Zithera Technology Pty Ltd ("Company", "we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the App.

Use License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes subject to these Terms.

You may:

Download and install the App on devices you own or control
Use the App for personal language learning
Create one account for your personal use

Restrictions

You agree NOT to:

Copy, modify, or distribute the App or its content
Reverse engineer, decompile, or disassemble the App
Remove any copyright or proprietary notices
Use the App for any commercial purpose without permission
Share your account credentials with others
Create multiple accounts to abuse free features
Use automated systems or bots with the App
Attempt to gain unauthorized access to our systems
Use the App in any way that violates applicable laws

User Accounts

When you create an account, you agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Promptly update any changes to your information
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

Subscriptions and Payments

Free Version

The App offers free features with advertisements. Free users have access to limited content and features.

Premium Subscription

Premium features are available through subscription:

Pay the subscription fee at the chosen interval (monthly/yearly)
Automatic renewal unless cancelled before the renewal date
Payment processing through Apple App Store or Google Play Store

Cancellation: You can cancel your subscription at any time through your App Store or Play Store account settings. Cancellation takes effect at the end of the current billing period.

Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. We do not directly process refunds for App Store or Play Store purchases.

Intellectual Property

The App and its original content, features, and functionality are owned by Zithera Technology Pty Ltd and are protected by international copyright, trademark, and other intellectual property laws. This includes:

App design and user interface
Lesson content and curriculum
Audio recordings and pronunciations
Graphics, logos, and illustrations
Software code and algorithms
Learndarin name and branding

Disclaimers

"As Is" Basis: The App is provided "as is" and "as available" without warranties of any kind.

Educational Tool: The App is an educational tool. We do not guarantee specific learning outcomes or fluency levels.

Availability: We do not guarantee uninterrupted or error-free operation. The App may be temporarily unavailable for maintenance.

Limitation of Liability

To the maximum extent permitted by law, Zithera Technology Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
